1. Description of Service

DecibelLab is a mobile application that provides noise measurement, audio analysis, and related tools, including but not limited to:

• Real-time sound pressure level (SPL) measurement in decibels (dB)
• Frequency spectrum analysis (FFT, octave band, 1/3 octave band)
• Noise dose estimation referencing NIOSH and OSHA occupational standards
• NC (Noise Criterion) and NR (Noise Rating) acoustic evaluations
• InstaDecibel camera: overlaying real-time decibel readings on photos and videos
• Configurable noise threshold alerts with automatic recording triggers
• Measurement data export in PDF, PNG, CSV, and WAV formats
• Background noise monitoring capabilities
• Multiple frequency weightings (A, C, Z) and time weightings (Fast, Slow, Ultra-fast)
• Manual calibration offset adjustment

2. Disclaimers and Limitations

2.1 Not a Certified Measurement Instrument

2.2 Measurement Accuracy

• All measurement results provided by the App are approximate values for informational and reference purposes only
• Accuracy depends on your device's microphone hardware quality, environmental conditions, acoustic interference, device orientation, protective case effects, microphone obstruction, and software calibration state
• Different device models will produce different results under identical conditions
• The App's manual calibration feature adjusts readings by a user-defined offset but does not constitute traceable calibration against a reference standard
• For any situation requiring accurate, legally defensible, or regulatory-compliant noise measurements, you must use a certified professional sound level meter (Class 1 or Class 2 per IEC 61672)

2.3 Standards References

• The App references IEC 61672 (sound level meters) and ANSI S1.4 standards for its frequency weighting filter design. These references describe the design approach only; the App is not certified or verified to comply with these standards
• NIOSH and OSHA noise dose calculations are provided as educational reference tools. They do not constitute occupational safety compliance monitoring and must not be relied upon for workplace safety decisions
• NC (Noise Criterion) and NR (Noise Rating) evaluations are approximations and should not replace assessments performed with calibrated instrumentation

2.4 No Professional Advice

• Noise exposure assessments and hearing risk indicators are estimates only and cannot replace professional audiological evaluation
• For concerns about hearing health, noise-induced hearing loss, or occupational noise exposure, consult a qualified audiologist, occupational health professional, or medical provider
• Do not rely on the App's alerts or measurements as your sole protection against hazardous noise exposure

2.5 User-Generated Content

The App enables you to create measurement records, audio recordings, annotated photos, videos, and exported reports. You are solely responsible for all content generated through the App and for how you use, share, or distribute such content. When using the App's audio recording or camera features, you must comply with all applicable laws regarding audio recording, photography, and video capture in your jurisdiction.

3. In-App Purchases and Subscriptions

3.1 PRO Features

The App offers premium ("PRO") features available through:

• Annual Subscription: Auto-renewable yearly subscription with a 3-day free trial for eligible accounts. The subscription automatically renews unless canceled at least 24 hours before the end of the current billing period
• Lifetime Purchase: One-time non-consumable purchase granting permanent access to all PRO features

3.2 Payment and Billing

• All purchases are processed through Apple's App Store and charged to your Apple ID account
• Pricing is displayed in your local currency as determined by the App Store
• We do not collect, store, or have access to your payment information

3.3 Cancellation and Refunds

• You may manage or cancel subscriptions at any time through your device's Settings > Apple ID > Subscriptions
• Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused portions
• Refund requests are handled exclusively by Apple. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com

3.4 Free Trial

Free trial eligibility is determined by Apple and your Apple ID account. If you have previously redeemed a free trial, you may not be eligible for another. At the end of the trial period, your subscription will automatically convert to a paid subscription unless canceled.

4. Acceptable Use

• You must use the App in compliance with all applicable local, national, and international laws and regulations
• You must not use the App to secretly record audio or capture images/video of individuals without their knowledge or consent where such action is prohibited by law
• You must not use measurement data, reports, or other output from the App to make false claims of regulatory compliance or to misrepresent noise conditions
• You must not reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• You must not redistribute, sublicense, or resell the App or any content generated by the App in a manner that infringes on our intellectual property

5. Intellectual Property

All intellectual property rights in the App and its content — including but not limited to source code, user interface design, visual assets, icons, sounds, algorithms, documentation, and trademarks — are owned by TooTooStudio and protected by applicable copyright, trademark, and intellectual property laws. "DecibelLab" and "InstaDecibel" are trademarks of TooTooStudio.

6. Limitation of Liability

• We do not warrant that the App's measurements are accurate, complete, reliable, or suitable for any particular purpose
• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to damages related to hearing loss, noise exposure, workplace incidents, regulatory non-compliance, or reliance on App measurements
• We are not responsible for any decisions, actions, or omissions made based on data, measurements, alerts, or information provided by the App
• Our total aggregate liability to you for any claims arising from or related to the App shall not exceed the amount you paid for the App or its subscriptions in the twelve (12) months preceding the claim

7. Indemnification

You agree to indemnify, defend, and hold harmless TooTooStudio and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any content you generate, export, or share using the App.

8. Service Changes and Termination

• We reserve the right to modify, update, suspend, or discontinue the App or any of its features at any time, with or without notice
• We may modify pricing, subscription terms, or feature availability through App updates
• Upon termination of your use, all licenses granted to you under these Terms will immediately cease

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the App shall be submitted to the competent courts in the jurisdiction where TooTooStudio is registered.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TooTooStudio regarding your use of the App and supersede all prior agreements and understandings.

12. Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected by the "Last Updated" date at the top of this page. Your continued use of the App after any modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
